Abstract
Research Title: Imam Al-Shafi’i’s argumentation based on the context in his interpretation of the verses of rules - Applied Analytical inductive Study
In the research - with Allah's help - the definition of context is mentioned, stating its importance and ruling, as well as mentioning examples of it. In the past and present times, interpreters have paid it attention.
And I have tried in this research: To show a part of the importance of the indication of the context and its impact in the correct argumentation from Sharia texts, and also revealing Imam Al-Shafi’i’s opinion of the indication of the context and its exploitation in academic debates and fiqah (jurisprudential) arguments, through his books which are attributed to him - may Allah have mercy on him.
And the research has concluded to some conclusions, the most prominent of which were:
1) The Academic dignity of Imam Al Shafi- May Allah have mercy on him; as he is one of the diligent imams in the science and principles of jurisprudence (Fiqah), and he is also one of the imams cited in language and rhetoric of the Arabic language.
2) The context has a great importance, in particular in the science of Tafsir (interpretation) of the Holy Qur’an; as it is one of the most prominent pieces of evidence that helps to understand what the speaker meant by his words with a correct understanding of what is meant by it, and also helps to on determine its ambiguity and interpret its aim, and also if the speech is general or absolute, it will be useful in specifying and limiting it.
The research has also concluded a recommendation which is: Revealing the opinions of the diligent imams of the prominent scholars who are peers of Imam Al-Shafi’i and their similar scholars in other centuries, and stating their opinions about the indication of the context.
